The vulnerable groups of employees who can be placed in teleworking status are defined by the JMC of the Ministries of Labor and Social Affairs and Health.
According to information from Dikaiologitika News, the vulnerable groups will be the same as those in the public sector. In particular it is:
-People over the age of 65 years. The date of birth of the person is taken into account for inclusion in this regulation.
-People with severe heart disease, or people with chronic cardiovascular disease, showing the following symptoms: left ventricular ejection fraction: 40%, active myocardial ischemia, Above-average stenosis or insufficiency of the mitral or aortic valve, Pulmonary Hypertension, history of recent cardiac surgery (three months ago), as well as cardiomyopathies, or symptoms of other cardiovascular disease of equal severity.
-People with persistent hypertension despite maximal treatment.
-People with severe lung disease or with chronic respiratory diseases of moderate to severe degree that fall under the following or even equal severity of symptoms: patients with asthma with 2 exacerbations in the last year, despite the maximum treatment (with β-stimulator and inhaled corticosteroid), COPD patients undergoing home oxygen therapy or presented 2 exacerbations in the last year and / or a hospital stay, patients on permanent oxygen therapy for other respiratory conditions, or even symptoms of another lung disease of equal severity.
-People with unregulated diabetes. Especially for people with unregulated diabetes, the following values are taken as indicative values: HbA1c of the last 3 months: ≥8.0% or M.O.. blood glucose values ≥200 mg / dL in the last 7 days and patients with micro / macro vascular complications, or even symptoms of equal severity.
-People with severe neurological / neuromuscular disorders.
– People with chronic end-stage renal disease, undergoing extrarenal dialysis.
-People with chronic liver failure (cirrhosis).
-People with a high body mass index (BMI>40).
-People with severe immunosuppression (relative or acquired) in the opinion of the treating physician - Transplants receiving 2 or more immunosuppressive drugs - HIV patients with CD4≤200 / μL.
-Patients diagnosed with cancer in the last five years or undergoing chemotherapy or radiotherapy, or immunotherapy.
-Patients with hematological malignancies, sickle cell anemia and transfusions.
For these categories of employees, the employer may by its decision determine that the work provided by the employee at the place of work provided by the individual contract, will be carried out with the system of remote work.
Employees belonging to vulnerable groups can work with the remote work system, at their request, expressed by any appropriate means, such as by telephone, email or mobile text message.
The employer must accept this request, if the work can be provided remotely.
If it is not possible to implement them, the employer takes measures, so that the applicant worker belonging to a vulnerable group does not provide work for the performance of which he contacts the public.
If this cannot be applied, the employer, as a last resort to protect an employee belonging to a vulnerable group, suspends his employment contract for a period of until 30 September 2020.
In cases where the employer, despite the proven request of the employee, does not apply the provision, including the sequential series of individual implementation steps, a fine is imposed, height 5.000 euro, for any violation.
