End to the transfer of detainees to attend trials, but also to ensure the protection of vulnerable witnesses while providing security for witnesses, who have been bullied, such as victims of abuse, bring televised trials that will largely abolish the testimony of witnesses.
The data is changing
Trials through an electronic platform are expected to change the court data by digitizing this chapter from 2022. THE Information Society (ΚτΠ) The executive arm of the Ministry of Digital Government has already "run" the relevant competition of its own via video conference, as pointed out by the CEO Stavros Asthenidis speaking at the 4th Athens Investment Forum, while the budget project close to 20 million is financed from the resources of the Recovery Fund.
According to Mr.. Asthenide, the work of e-justice that will soon bring to our lives the tele-trial, is a major intervention in the field of Justice. It will include the digitization of files, but also the procedures of Justice for the operation of the courts: «"All this will go through new platforms that will be created", he noted, citing tele-trial as an example: "We have already run a competition and we are in the phase of the first signatures for the project of the televisions. The philosophy of the project includes the possibility of the listening process, examination of witnesses can be done remotely. "In other words, someone imprisoned in Malandrino prison will not be required to go to Rhodes, for example, in order to testify," he stressed..
According to the project announcement, the estimated value of the contract is the amount of 19.228.928,37 including VAT and concerns two main actions:
– Integrated teleconferencing services in courts and penitentiaries
– Information services on the course of the signs and exhibits of the Courts
The purpose of the first action is the introduction ́ and utilization of modern technological tools in the process of administration of Justice. This is because the movement of witnesses and defendants creates additional financial burdens that are borne by either the citizens in civil proceedings or the state in criminal proceedings..
Simultaneously with remote deposits The work of Justice is also expected to be upgraded, especially in cases where the testimony of vulnerable witnesses is required – such as minors – or witnesses who have been intimidated, such as victims of abuse and their livelihood in court may disturb their mental health and affect the trial process. In addition, the use of video conferencing is expected to speed up the investigation as well as the processing of requests for legal assistance., as indicated in the text of the project notice.
As part of the action, one will be implemented network of teleconferencing services in courts and penitentiaries of the country, meeting the needs of the Policies, Criminal and Administrative Courts (Court of First Instance and Court of Appeal), of the investigative work (Court of First Instance) and requests for legal assistance.
The scope of the action concerns Judicial Bodies (Ario Pagos, Council of State, Politics – Criminal and Administrative Courts of Appeal and Courts of First Instance and Magistrates' Courts) and Penitentiary Stores. More specifically, video conferencing systems are expected to be installed in a part of the courts of First Instance and Courts of Appeal, in certified premises within the courts but also inside the penitentiary establishments (witness filing rooms) and in investigative offices and offices that serve requests for legal assistance.
It will be possible through video conferencing systems:
- The remote testimony / examination of a witness in a case being tried, who at the time of the trial is far from the place of the trial. In this case, the witness will come to one of the certified premises that will be set up and will testify remotely live. (with image and sound).
- The remote testimony / examination of a case witness, which is located abroad́ – Cross-bordeŕ.
- The remote testimony / examination of a witness or accused who is a detainee in a penitentiary.
- The conduct of the preliminary examination, pre-trial investigation and interrogation.
- Satisfaction with remote connection of Judicial Assistance requests.
- Combination of the above cases as it will provide the possibility for multi-conference.
Practically the certified users of the system (judges and lawyers) will be able to apply electronically for remote examination of witnesses / defendants and receive the relevant approval electronically.
The project will supply and install teleconferencing equipment and software, of the materials that will be required for the configuration of the rooms (displays, cameras, microphones etc.), central equipment to support teleconferencing and multi-conference, as well as the equipment and software for the implementation of the Reservation and Workflow Management system. The central equipment will be hosted in the data center of the Ministry of Justice or in another data center of the Judiciary.
The object of the project also includes the training of the staff of the Judicial Bodies (Judicial Officers and Judicial Staff) in the use of the system, based on the training plan and depending on the category of trainees (Administrators, Senior Users, Ordinary Users).
The second action of the project concerning the information services of the course of the signs and exhibits of the Courts, aims to better serve lawyers, parties and those involved in court proceedings in the courts of the country and the modernization and improvement of the quality and efficiency of the services provided by the Judiciary and the upgrading of the administrative capacity of the Courts.
Philosophy of the project is its achievement real-time publication of the course of the paintings and exhibits of the Courts of the country on the internet, to those interested (Lawyers, citizens etc.).
In addition, the possibility of immediate and real-time updating of the course of the signs will be given through special applications that will work on electronic devices (smartphones, tablets etc.), for the best service of lawyers, of the parties and those involved in court proceedings in the courtrooms. These applications will support multi-channel access to the personal devices of the interested parties, or via mobile telephony, or via wireless network in specific areas (indoor and outdoor) of the judicial complexes of the country. That is why the development of a wireless access network for the public and lawyers will be implemented..
